Terms and Conditions

Transfer2you offers a website that makes it easy to send large files, such as photos and videos. The specified email addresses receive a link to a web page where the uploaded files can be downloaded as a whole or individually.

Rights and Copyright

Files sent via Transfer2you remain the property of the rights holder. Transfer2you acts solely as an intermediary and accepts no responsibility for the use of the files.

Usage

Our services may only be used if you are 16 years of age or older.

By using our services, you agree to our Terms and Conditions.

With Transfer2you you can share files with third parties. The files in question must be uploaded to us and are only shared with the email addresses you provide. Transfer2you accepts no responsibility for the content or use of files shared through us. You are solely responsible for the content you upload and share through our services. Any liability for damages related to the Content lies with the person who creates, uses, stores and/or shares it within Transfer2you. You acknowledge that download and/or access links may be forwarded and that recipients who have access to such links have access to the content associated with them. By using our services, you guarantee that for all content you create, use, store or share using our services, you have all required permissions (including from copyright holders and other intellectual property rights holders) to distribute, sublicense, transfer, store and/or make the content available online. Transfer2you is not liable to you or any third party for any damage arising from or related to content created, used, stored or shared by you within the Services, including but not limited to copyrighted works and/or trademarks.

Transfer2you will not sell or advertise the content: Transfer2you only requires the license for the purpose of enabling our services and serving your recipients. Transfer2you does not offer a public search function, catalog or listing to find content. Transfer2you may show you or your recipients advertisements from advertisers when our services are used.

After the expiration period of 14 days for a standard membership, or 21 days for a premium membership, the files are automatically deleted by us. This deletion is permanent; the files cannot be retrieved afterwards.

Restrictions

Transfer2you respects your rights and expects you to respect those of others, including Transfer2you, advertisers and third parties. This includes respecting the right to privacy and intellectual property rights, such as trademarks, copyrights, trade names and logos. You agree not to use our services to commit, promote, enable or facilitate unlawful or criminal acts or violations of these Terms and Conditions, or to facilitate or promote others to do so.

As a condition of using the Services, you agree not to create, use, store or share content that:

is obscene, defamatory, blasphemous, indecent, discriminatory, threatening, offensive, harmful, immoral, vulgar or unlawful;
promotes racism, violence or hatred;
is factually incorrect, untrue, misleading, misrepresentative or deceptive;
you have no rights to;
infringes or abuses intellectual property rights, privacy rights, including data protection rights and/or any other type of rights;
infringes or conflicts with applicable laws or regulations; and/or contains 'hate speech', whether directed at an individual or a group, and whether based on race, gender, belief, national origin, religious conviction, sexual orientation, language or any other characteristic of such person or group.

Furthermore, you agree not to use our service to:

abuse, harass, stalk, intimidate, threaten, commit violence or otherwise act unlawfully, or encourage someone else to do so;
impersonate or falsely claim to be affiliated with any person or entity;
gain access to non-public parts of our services;
interfere with any access or usage restrictions;
use data mining or data collection or extraction methods, or otherwise collect information about the users of our services;
send viruses, worms, malware, ransomware, unsolicited email, spam, chain letters, phishing emails, unsolicited messages, promotions or advertisements of any kind and for any purpose;
interfere with, damage or disrupt our services or act in a way that could do so;
attempt to probe, scan, compromise or test the vulnerability of the Services or any related service, system or network, or breach security or authentication, unless you do so with our prior approval;
use automated means to access or use our services without our permission;
reverse engineer or decompile any (part of) our services;
resell, sublicense, rent, lease, offer or otherwise commercialize the Services without our permission; and/or allow others to use your account.

Transfer2you reserves the right to investigate, provide to third parties, (temporarily) block and/or permanently remove content and/or account information from its servers, without prior notice or liability, or to block anyone from accessing any part of our services, when Transfer2you at its sole discretion or upon receipt of well-founded complaints determines that you are violating these Terms or acting in conflict with applicable laws or regulations.

Transfer2you is not responsible or liable for third-party content published within our services, in-ad links to external websites or the content, products or services offered on external websites. You acknowledge and accept that all use outside the Services is at your own risk.

Premium

In addition to the free membership, we offer a Premium membership. Compared to the free membership, it offers the following benefits:

Emails to the specified recipients do not show advertisements.
No advertisements on the download page.
Files are stored longer (21 days instead of 14 days).
The ability to display custom backgrounds on the download page. The backgrounds can be linked to your own website.
The ability to upload larger files (up to a maximum of 2 GB per file).

Payment for the premium membership is processed via iDeal or Bancontact. The premium membership costs € 75.00 excluding VAT per year and starts on the day payment is received by us.

Transfer2you reserves the right to adjust the price of the premium membership at any time. Existing memberships can always be completed at the price for which they were purchased. The membership is not automatically renewed.

An existing subscription can be cancelled at any time. This does not entitle you to a refund of subscription fees already paid.

Disclaimer

Transfer2you provides its services "AS-IS", without any warranty. Without limiting the foregoing, Transfer2you expressly disclaims all warranties of merchantability, fitness for a particular purpose and non-infringement. Transfer2you does not guarantee that the Services will be available without interruption, securely or without errors. Your use of our services is at your own risk. You acknowledge and agree that Transfer2you is not responsible for any damage to your or a third party's computer system resulting from the use of our services and is not responsible for the failure of our services or for the corruption or loss of data, information or content in a file.

Transfer2you may modify, terminate or expand its services from time to time and reserves the right, at its sole discretion, to restrict access to or remove features or functionality from our services.

To use our services, you must register and provide us with information such as your email address, address or password. You must ensure that this information is correct and keep it updated in your account settings. You are responsible for all activities on or through your account, so you must not share your password and must protect it carefully. If registrations or account data appear to have been misused, Transfer2you reserves the right to delete the account. Transfer2you is not liable for loss or damage resulting from unauthorized use of your account.
